Commercial Litigation

Chambliss represents regional, national, and international clients from a variety of industries in business litigation, ranging from simple disputes to complex cases. Our litigation team advises on a variety of matters including claims for breach of contract, UCC secured transactions, commercial paper, and sales of goods, breaches of representations and warranties, suits on guarantees, business purchases, and many other kinds of claims. We often assist clients in commercial litigation involving a "divorce" of members or shareholders where the owners of a closely held business have irreconcilable differences. No matter the issue, we work with clients to understand what's at stake and devise a game plan to meet their litigation goals in the most cost-effective manner. Our attorneys are extremely responsive and will always put the client's business interests first.

Experience

  • Obtained a jury verdict in federal court in Toledo, Ohio, of more than $1 million (including attorney's fees) for a Belgian aircraft company relating to its purchase of a jet aircraft with undisclosed problems

    Successfully defended a manufacturing client in warranty claim by customer, and obtained judgment on a counter-claim against customer for failure to pay for equipment

    Enforced landlord's right to compel tenant's contribution to common area maintenance, including substantial charges for paving driveways and parking areas

    Successfully defended breach of contract claim against purchaser who rejected manufacturing equipment due to defects

    Successfully defended securities lawsuit with fraud and racketeering allegations

    Successfully mediated and resolved a dispute over extra-contractual and change order work on a large industrial carbon fiber manufacturing facility

    Filed suit and then resolved claims for extra-contractual work on the recovery steam piping and related work at the Browns Ferry Nuclear Power Plant in Alabama
