Profile

Brad maintains a diverse practice focused on helping businesses get their products and services out to the marketplace. He advises clients on regulatory compliance matters and risk management issues, represents clients in the courtroom, and also assists clients with a variety of business and transactional matters. Brad is experienced in representing clients of all sizes, from established household names to budding startups that hope to one day become household names. These clients span numerous industries, some of which include equipment and food manufacturing, financial technology, telecommunications, transportation and logistics, and banking.

Before joining Chambliss, Brad practiced law for several years in Atlanta at a multi-national AmLaw 100 firm where he represented numerous Fortune 500 companies and other clients in high-stakes litigation and regulatory matters.

Experience

  • Serves as "outside general counsel" for a FinTech startup based in St. Louis. Brad has advised on entity formation, negotiated and drafted agreements with channel partners and outside vendors, and worked on the legal team that has raised three rounds of funding for the company

    Successfully resolved a lawsuit against a community bank by another bank alleging damages in excess of $30 million for alleged breaches of restrictive covenants, misappropriation of trade secrets, and business torts

    Drafted several friend-of-the-court briefs on behalf of the Tennessee Chamber of Commerce in actions pending before the Tennessee Supreme Court and Tennessee Court of Appeals

    Won summary judgment on behalf of a heavy-equipment manufacturer in a lawsuit brought by a former employee alleging violations of the Family and Medical Leave Act

    Defeated attempt at class certification in California federal court by wholesale distributors of food products who alleged they had been misclassified as independent contractors by a national food manufacturer

    Drafting employment agreements and providing related counseling regarding the enforceability of noncompetes and other restrictive covenants

    Successfully enforced a noncompete and other restrictive covenants against a former outside sales employee of an industrial MRO equipment seller

    Won a lawsuit in federal court on behalf of a cell tower company following a local municipality’s wrongful denial of a tower construction permit

    Successfully resolved numerous lawsuits brought against an herbicide applicator that alleged personal injuries and property damage resulting from herbicide application along utility rights of way

    Represented a national directory assistance provider in related proceedings before Georgia and New York federal district courts, the Second and Eleventh Circuit Courts of Appeals, and the FCC regarding the interpretation of federal statutes and regulations governing access to directory listing data

    Obtained legal judgment for fast-casual restaurant franchisor against former franchisee for misuse of trademarks and proprietary information
