Profile
For more than 20 years, Theresa Critchfield has represented businesses, contractors, subcontractors, architects, engineers, suppliers, developers, and owners across the construction and real estate industries in both transactional matters and disputes. Her practice spans commercial and residential construction, real estate disputes, and business litigation. With extensive experience working with all parties on construction projects — from initial contract negotiation through project completion — she provides practical, business-minded counsel at every stage.
Theresa drafts and negotiates contracts for projects ranging from modest to multimillion-dollar builds and prepares agreements for her clients. She regularly advises on initial contracts, change orders, contractor licensing, and risk management strategies designed to minimize disputes and strengthen project outcomes. When conflicts arise, Theresa represents clients in state and federal courts, as well as in mediation and arbitration, involving payment disputes, indemnification issues, construction and design defects, delay and acceleration claims, differing site conditions, structural issues, and breach and termination matters. She also handles claims involving mechanic’s and materialmen’s liens, payment and performance bonds, lien discharge bonds, and related issues under the Prompt Pay Act and Consumer Protection Act.
Having grown up in a family business that served suppliers, Theresa developed deep roots in the business and construction worlds and understands the day-to-day realities her clients face. She partners with construction and commercial businesses to negotiate favorable contract terms, navigate project challenges, and address issues such as payment disputes, delays, and defect claims while keeping their long-term goals at the forefront. Theresa approaches every relationship as a true partnership — listening closely, investing in her clients’ success, and working alongside them to reach a positive solution.
As a result, Theresa is a trusted advisor who helps businesses grow and protect what they have built. She provides counsel on construction and real estate disputes, including commercial landlord-tenant matters and other real property conflicts, and helps clients establish strong protections up front while remaining prepared to guide them through challenges as they arise.
