The 16th annual report outlines expected litigation shifts, client spending trends, emerging industry opportunities, and the factors driving client law firm selections in 2026.
According to BTI, the litigation market in 2026 is accelerating and becoming more complex, with disputes increasingly high-stakes and business-critical. More than two-thirds of companies are increasing litigation budgets, many by over 10%, driven by AI-related IP disputes, class actions, cybersecurity claims, employment litigation, and larger breach-of-contract matters.
BTI notes that law firms can differentiate themselves by responding to these trends with speed, precision, and innovative approaches, including:
- Early assessments and strategic planning for complex matters
- Developing rapid, creative solutions tailored to each client’s industry
- Leveraging experience in emerging practice areas and fast-growing segments
- Employing scenario planning and collaborative problem-solving to navigate multiple possible outcomes
The report also identifies the fastest-growing segments, practice areas with the highest premiums, and the industries with the greatest opportunities in 2026.
The study’s methodology relies on a group of top legal decision-makers at organizations with $1 billion or more in revenue. More than 350 in-depth telephone interviews were conducted to identify the firms best suited to meet each participant’s most pressing litigation needs. The independent and unbiased study interviewed individuals from a broad range of industries, including banking, chemicals, consumer goods, energy, financial services, food and agriculture, health care, high tech, insurance, manufacturing, pharmaceuticals, professional services, retail trade, real estate, telecom, transportation, regulated utilities, and wholesale trade.
